Changes to the General Terms

SmartPosti has made changes to the General Terms to ensure greater transparency and a more unified approach to service delivery in the Baltic countries. The new terms will come into effect on 01 August 2025. 

Overview of Changes to the General Terms 

  1. Scope and Structure of the Agreement  The new general terms have been developed with the needs of all three Baltic countries in mind, introducing a unified approach to service provision in the region. This is a significant step for customers with cross-border operations, providing greater clarity and consistency. 

  2. Liability Limitations and Compensation Procedure  Compared to the previous terms, the new terms define liability limitations in greater detail, including specific compensation caps (e.g., 8.33 SDR/kg for warehouse losses). This provides greater legal clarity, although the overall level of liability has not changed significantly. 

  3. Customer Obligations and Data Responsibility  The new version clearly defines the customer's obligations, including providing accurate and truthful information about shipments, data, and communication channels. The customer must ensure that data (e.g., address, goods description) is correct, as it serves as the basis for service provision and invoicing. 

  4. Contract Termination Provisions  The terms grant SmartPosti the right to unilaterally terminate the contract without notice if the services have not been used for 12 months. They also specify the possibility to transfer the contract to another group company or a third party in the event of a business transfer. 

  5. Intellectual Property and Brand Use  The terms clearly specify that SmartPosti retains all rights to service marks and visual elements. Customers wishing to use SmartPosti brands in their marketing must obtain prior approval and comply with brand guidelines.
